Dr. Cathy Frank and CPSO make a deal: Dr. Frank ceases practicing medicine as of January 15, 2013.

On January 15, 2013, Dr. Cathy Frank, a physician practicing in Ontario and a member of the College of Physicians and Surgeons, agreed and undertook to the College to cease practicing medicine. The College website shows Dr. Frank as an active member.

Over 100 women contacted the firm about their treatment and that of their babies at the hands of Dr. Frank. Approximately 60 women have issued claims for themselves and several more actions are under investigation for compromised babies, and one has been commenced.

These women have made complaints to the CPSO as far back as 2006 about Dr. Frank. Even though the College conducted an investigation into several complaints, its Complaints Committee has never sent Dr. Frank’s case to its public Discipline Committee. The firm appealed this ruling of the Complaints Committee to the Health Professionals Appeal Review Board, arguing that the breadth and duration of the concerns mandated a full public hearing. While this decision was under reserve ( the hearing was held on December 18, 2012) the College and Dr. Frank, in negotiations that took place out of the public eye, agreed to her ceasing practice.

We continue to await the decision of HPARB because Dr. Frank may yet apply in future for reinstatement of her right to practice medicine. Further, we are of the view that the public, including the many women treated by Dr. Frank who are not part of any lawsuits, have the right to know what happened and why this outcome took so long. While it is good news to the women who bravely pursued their complaints with the College and commenced lawsuits, that Dr. Frank has ceased practice, the information that is now tightly held behind closed doors continues to be a concern for them.
